Welcome! Please read these TechCeler Terms of Service (the "Agreement") carefully.

This Agreement is a legally binding contract between you and TechCeler, operated by Daniel Martinez Ruiz ("TechCeler," "we," or "us"), a business registered in Texas. By using our lead generation services or accessing our website at techceler.tech or any related domains (the "Services"), you agree to this Agreement and confirm that you are of legal age to enter into it.

This Agreement governs your access to and use of all services provided by TechCeler via our online platform at techceler.tech or any related domains (the "Services"). This Agreement also incorporates by reference any additional terms posted by TechCeler in connection with the Services.

1. Service Description

TechCeler provides lead generation and digital marketing services, including but not limited to:

  • Identification and qualification of potential business prospects
  • Multi-channel advertising campaigns across social media and digital platforms
  • Lead nurturing and engagement services
  • Performance analytics and reporting

Our services are designed to help businesses connect with qualified prospects who have demonstrated interest in their products or services.

2. Permitted Use and Restrictions

You may use our Services only for lawful business purposes. You agree not to:

  • Use the Services for any illegal, fraudulent, or unauthorized purpose
  • Violate any applicable laws, regulations, or third-party rights
  • Attempt to gain unauthorized access to our systems or networks
  • Interfere with or disrupt the operation of our Services
  • Use the Services to send spam, unsolicited communications, or malicious content
  • Reverse engineer, decompile, or attempt to extract source code from our Services

3. Lead Qualification and Delivery

TechCeler will work with you to establish specific criteria for qualified leads, including:

  • Industry and company size requirements
  • Geographic targeting parameters
  • Budget and decision-making authority criteria
  • Demonstrated interest or engagement levels

You will only be charged for leads that meet the agreed-upon qualification criteria. Lead delivery times vary by service tier as outlined in our pricing structure.

4. Pricing and Payment Terms

Our pricing structure is based on qualified leads delivered:

  • Social Media Leads: $40 per qualified lead
  • Multi-Channel Leads: $50 per qualified lead
  • Premium AI-Powered Leads: $60 per qualified lead

Payment terms will be established in your service agreement. We reserve the right to modify pricing with 30 days' written notice.

5. Data Privacy and Protection

We are committed to protecting your privacy and the privacy of leads generated through our Services. Our data handling practices are governed by our Privacy Policy, which is incorporated by reference into this Agreement. You agree to comply with all applicable data protection laws and regulations.

6. Intellectual Property Rights

TechCeler retains all rights, title, and interest in our proprietary technology, algorithms, and methodologies. You retain ownership of your business information and data provided to us, subject to our right to use such information to provide the Services.

7. Disclaimers and Limitations

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TECHCELER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TechCeler's liability for any claims arising from or related to the Services shall not exceed the amount paid by you for the Services in the twelve months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless TechCeler from any claims, damages, losses, or expenses arising from your use of the Services, violation of this Agreement, or infringement of any third-party rights.

9. Termination

Either party may terminate this Agreement with 30 days' written notice. TechCeler may terminate immediately if you breach any material term of this Agreement. Upon termination, you remain liable for all charges incurred prior to termination.

10. Governing Law and Disputes

This Agreement is governed by the laws of the State of Texas. Any disputes arising from this Agreement shall be resolved through binding arbitration in Odessa, Texas, or through the courts of Ector County, Texas.
